Terms and Conditions – Primal Gems UG (haftungsbeschränkt)
1. Scope of Application
These Terms and Conditions apply to all purchases and orders placed in the online store (“webshop”) operated by Primal Gems UG (haftungsbeschränkt), available at www.primal-gems.com.
Primal Gems UG (haftungsbeschränkt) may update these Terms and Conditions for future orders. The version valid at the time of your order applies to your purchase.

Important Disclaimer:
All products are for external use only. This means:
- Apply only to the skin.
- Do not ingest, inhale, or use in the eyes, mouth, nose, ears, or intimate areas.
- Avoid application to broken, inflamed, or irritated skin unless otherwise specified.
Before use, always read the product label and instructions carefully. Perform a patch test before first use, especially if you have sensitive skin or known allergies, for example to essential oils such as tea tree or lavender.
3. Orders and Payment
By placing an order through the webshop, you make a legally binding offer to purchase the selected product(s) from Primal Gems UG (haftungsbeschränkt).
Prices
All prices are shown in euros and include the statutory VAT. Shipping is free for all orders within the EU. For deliveries outside the EU, import duties or taxes may be charged by the destination country.
Payment
Payment is due at the time of order using the payment methods available at checkout. Primal Gems UG (haftungsbeschränkt) accepts major credit cards, PayPal, and other secure payment options.
Order Acceptance
You will receive an email confirmation after placing your order. This confirmation does not constitute final acceptance. The contract is concluded when we dispatch your order or send a shipping confirmation.
Primal Gems UG (haftungsbeschränkt) reserves the right to cancel or reject orders in cases of:

- Technical issues
- Payment problems
- Suspected fraud
- Violation of these terms
If an order is cancelled, any payment already made will be refunded in full.
4. Shipping and Delivery
Primal Gems UG (haftungsbeschränkt) dispatches orders within 24 hours on working days. Estimated delivery times are shown in our Shipping & Delivery Policy and may vary by location.
Orders are shipped to the delivery address you provide. Please ensure all details are correct. For consumers, the risk of loss or damage passes to you upon delivery of the goods. If a parcel arrives damaged, please contact us at support@primal-gems.com.

5. Right of Withdrawal and Returns
Under EU law, you have the right to withdraw from your purchase within 14 days of receiving the goods, without providing a reason.
To exercise this right, contact Primal Gems UG (haftungsbeschränkt) by email at support@primal-gems.com with a clear statement of your decision.
Return Conditions:
- Products must be unopened, unused, and with the seal intact.
- Opened or unsealed skincare products cannot be returned for hygiene reasons (§ 312g (2) no. 3 BGB), unless they are defective.
- Return shipping costs are your responsibility unless the product is defective or we sent the wrong item.
Refunds are issued within 14 days of receiving your withdrawal notice, via the original payment method. We may withhold the refund until we have received the returned goods. See our Return & Refund Policy for full details.
6. Warranty and Liability
You are entitled to your statutory warranty rights under German law.
Results may vary depending on skin type, condition, and external factors. Always perform a patch test before full use.
Limitation of Liability:
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For slight negligence, we are only liable for breach of essential contractual obligations, limited to the foreseeable damage typical for this type of contract.
7. Retention of Title
All products remain the property of Primal Gems UG (haftungsbeschränkt) until payment has been received in full.
8. Privacy and Data Protection
Primal Gems UG (haftungsbeschränkt) is committed to protecting your personal data in accordance with the General Data Protection Regulation (GDPR) and applicable German data protection laws.

9. Intellectual Property

10. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law does not remove the protection of mandatory consumer law in their country of residence.
If a dispute arises, the court of jurisdiction is the registered office of Primal Gems UG (haftungsbeschränkt) in Wassenberg, Germany, provided the customer is a merchant or legal entity under public law.
Consumers may also bring claims in their country of residence in accordance with applicable consumer protection laws.
